Welcome to BellyZelly. These Terms of Use ("Terms") govern your access to and use of the website located at bellyzelly.com, including all games, content and services offered on it (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What BellyZelly Is (and Is Not)

BellyZelly is a free-to-play social casino offered strictly for entertainment and amusement purposes only. The Service:

• does not offer or promote real money gambling in any form;
• does not provide any opportunity to win real money, real-world prizes, or anything of monetary value;
• does not accept bets, wagers, deposits or payments of any kind;
• does not offer in-app or on-site purchases; the Service is completely free and no purchase is necessary to play any game.

Practice or success at social casino gaming does not imply and does not guarantee future success at real money gambling.

2. Eligibility (21+)

The Service is intended solely for users who are 21 years of age or older. Although no real money is involved, the games simulate casino-style play and are not intended for minors. By registering you represent and warrant that you are at least 21 years old. We may suspend or terminate any account we reasonably believe belongs to a person under 21.

3. Your Account

To access the games you must create an account with a valid email address and confirm that email address. You agree to provide accurate information, keep your password confidential, and notify us of any unauthorized use of your account. You are responsible for all activity under your account. One account per person; accounts are personal and may not be sold or transferred.

4. Virtual Credits

Games on the Service run in demo mode using virtual credits ("Credits"). By using the Service you acknowledge and agree that:

• Credits are a limited, personal, non-exclusive, non-transferable, revocable license to use a feature of the Service. They are not your property;
• Credits have no monetary value and can never be exchanged, redeemed, withdrawn, sold or transferred for real money, goods, services or any item of real-world value, whether inside or outside the Service;
• Credits cannot be purchased. They are provided free of charge within the games and may reset when a game is restarted;
• we may adjust, reset or remove Credit balances at any time, including on account termination, without compensation;
• any attempt to sell, trade or transfer Credits is a violation of these Terms and may result in account termination.

5. Acceptable Use

You agree not to: (a) use the Service if you are under 21; (b) use bots, scripts or automation to access the Service; (c) attempt to interfere with, disrupt or reverse engineer the Service; (d) impersonate another person or create accounts with false information; (e) use the Service for any unlawful purpose.

6. Intellectual Property

The Service, including all games, graphics, logos, text and software, is owned by BellyZelly or its licensors and is protected by copyright and other intellectual property laws. We grant you a limited, personal, non-commercial, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute or create derivative works from any part of the Service without our prior written consent.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Responsible Play

Even though no real money is involved, we want play to stay fun. If you feel your play is becoming a problem, please read our Responsible Play page. You may request account closure at any time by contacting us at support@bellyzelly.com. 9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLYZELLY AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. BECAUSE THE SERVICE IS FREE, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100).

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or where required by law. You may stop using the Service and request deletion of your account at any time. Sections 4, 6, 9, 10 and 13 survive termination.

12. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be indicated by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction. You agree that any claim must be brought within one (1) year after it arises.
